Docket number 85247 is an appeal from the district court's order resolving a motion to retax costs. Docket number 85541 is an appeal from the judgment on the jury verdict, and Docket number 85596 is an appeal from the district court's order denying a motion for a new trial and denying a motion for a protective order regarding use of non-party medical records. Appellant and respondent Marilyn Martyn has filed a motion to consolidate all 4 appeals because they all arise from the same district court proceedings and involve the same parties and issues. The motion is opposed, and Martyn has filed a reply. Because of the different procedural postures of the appeals, consolidation of all 4 appeals at this point is not practical. Accordingly, the motion to consolidate all 4 appeals is denied. Nevertheless, Docket Nos. 85541 and 85596 shall be consolidated for all appellate purposes and shall be clustered with Docket Nos. 85193 and 85247 for the purpose of resolution to ensure that they are resolved in a consistent and efficient manner. The briefing schedule for Docket Nos. 85193 and 85247 shall remain as currently set. The briefing schedule for Docket Nos. 85541 and 85596 is modified as follows. Appellant and respondent Marilyn Martyn shall have until March 15, 2023, to file and serve the opening brief and appendix. Respondents and appellants Russell Nevins, M.D.; R. Nevins, M.D., Ltd.; and Nevada Orthopedic & Spine Center, LLP (Nevins) shall have 30 days from the date the opening brief is filed to file a combined answering brief and opening brief. Thereafter, Martyn shall have 30 days from service of Nevins' brief to file a combined reply brief and answering brief.
