On December 5, 2023, real party in interest filed a notice of supplemental authority that included a copy of a supplemental order the district court entered, sua sponte, on November 27, 2023. It is unclear why the district court filed its supplemental order approximately 1 year after this case was filed in this court and 7 days after this court filed its order setting the matter for oral argument. In response to the filing of the notice of supplemental authority, petitioners have filed an emergency motion to continue the oral argument that is scheduled in this matter for December 19, 2023, and a request for this court to schedule briefing on the issues that are raised by entry of the November 27, 2023, order. Real party in interest has filed a response to the motion. Petitioners have filed a reply. The motion to continue oral argument is denied. The November 27, 2023, supplemental order does not fall within the scope of NRAP 31(e); however, the parties will be given an opportunity to address whether the supplemental order should be considered by this court and, if so, to what extent.
