Nevertheless, in this instance only, this court elects to consider the motion on its merits. The motion to strike and for sanctions is denied. Ms. Mezzetti-Omler and Ms. Kernan are advised, however, that any future extension motions that do not comply with this court's rules may be rejected or stricken. The extension motion is granted to the following extent. Ms. Kernan shall have 7 days from the date of this order to file the requested transcript in the district court, deliver copies to the requesting party, and file a notice with this court that the completed transcript has been filed and delivered. On February 7, 2024, appellant Robert Pilkington filed a transcript request form requesting the production of an October 31, 2023, transcript from Litigation Services. On February 27, 2024, Robert filed a notice informing this court that he had two recordings "transposed" at his own cost by Rev.com. Attached to the notice are two transcripts, which Robert identifies as the transcripts of proceedings held on February 28, 2023, and June 26, 2023. Robert identifies four other transcripts, states those transcripts were filed in the district court and in this court in Docket No. 85647, and indicates that he will reference those transcripts but not file them in this matter. Robert also states his intent to file transcripts from October 31, 2023, and February 27, 2024, hearings when they become available. Respondents Janet E. Lenk Cohen, Hunter Liggett, Kristin Noel Lenk Pfeifer, Carin Lenk Sloane, and Jill Rene Stynda (hereinafter, respondents) have filed a motion to strike all uncertified transcripts from the appellate record, including those related to hearings occurring on February 28, 2023, June 26, 2023, August 24, 2021, September 14, 2021, May 19, 2022, and September 27, 2022. Respondents contend the transcripts were not properly requested and are uncertified, inaccurate, and extraneous. They also request the imposition of sanctions against appellants. Appellants oppose the motion. Appellants concede that they only filed a transcript request form for the October 31, 2023, hearing and argue that the February 27, 2024, notice substantially complies with NRAP Form 15. Initially, it appears an explanation of the rules pertaining to the transcripts in this matter may be helpful. This appeal is subject to the provisions of NRAP 9. NRAP 9 provides that if production of a transcript is required for an appeal, a pro se appellant who has not been granted in forma pauperis status must file a transcript request form requesting the production of that transcript, serve the request form on the responsible court reporter or recorder, and pay the appropriate deposit. Here, appellants did not file transcript request forms regarding the February 28, 2023, and June 26, 2023, proceedings. The purported transcripts of these proceedings attached to the notice and opposition are not certified and do not contain a concordance indexing keywords. The transcripts are deficient and are not properly considered by this court unless they were filed in or considered by the district court in the underlying proceedings and thus constitute part of the record on appeal. Under these circumstances, the motion to strike is granted to the following extent. The clerk shall strike the transcripts attached to the February 27, 2024, notice and April 15, 2024, response. The August 24, 2021, September 14, 2021, May 19, 2022, September 27, 2022, and February 28, 2023, transcripts identified in the notice are not from proceedings in the underlying district court case. Therefore, appellants may not reference those transcripts in their briefs unless those transcripts are part of the record on appeal. Respondents' request for sanctions and appellants' request to proceed under NRAP 9(d) are denied. Once the transcript of the October 31, 2023, proceedings is produced, appellants may file a copy of the transcript in this court pursuant to NRAP 9(b)(1)(B). It is the responsibility of the court reporting service from whom the transcript was requested and the assigned court reporter, in this case, Julie Kernan of Litigation Services, to file a copy of the transcript in the district court and file in this court a notice of filing and delivery of the transcript in accordance with NRAP 9(c)(2). Finally, appellants are advised the transcript of proceedings occurring on February 27, 2024, is not properly considered in this appeal because those proceedings occurred after entry of the district court orders challenged in this appeal and after the docketing of this appeal in this court.
