03/25/2024Order/ProceduralFiled Order Granting Motion. Before this court is real party in interest's motion to file its appendix volume 2 under seal. Real party in interest asserts that this volume, which consists of two competency evaluations of petitioner, contains medical and mental health information protected by the Health Insurance Portability and Accountability Act. Petitioner objects to the filing of this appendix based on asserted irrelevance to resolution of the instant writ petition. The evaluations real party in interest seeks to file under seal include medical and/or mental health records, which are grounds to seal said records, and this court agrees that the evaluations should be filed under seal. Furthermore, although petitioner contends said records are irrelevant to the resolution of the petition, they may be essential to understand the matters set forth in the petition. Therefore, real party in interest's motion to file its appendix volume 2 under seal is granted. The clerk shall file volume 2 of the appendix received on March 6, 2024, under seal. (SC)24-10478
