ACLUN has moved to dismiss CCSD's cross-appeal as moot, asserting that CCSD's cross-appeal raises issues as to the confidentiality of the requested records, but CCSD has already complied with the district court's December 18 order by releasing the subject records, such that this court could afford CCSD no relief even if it prevailed on its appellate arguments. Separately, ACLUN also asserts that the cross-appeal should be dismissed as defective because CCSD did not obtain authorization from the CCSD Board of Trustees to file it. CCSD opposes dismissal, arguing that that the cross-appeal is not moot because a dispute remains as to records the district court did not order disclosed, which is the basis of ACLUN's appeal, and that, even if moot, the capable-of-repetition-yet-evading-review exception applies to render the cross-appeal viable. The cross-appeal is dismissed on mootness grounds, we need not reach whether the cross-appeal was defective for lack of authorization.
