Bailey was entered as counsel for appellant per NRAP 3C(b). Mr. Bailey now "moves to disassociate from the appellant and appeal" because he no longer practices criminal defense and appellant filed the notice of appeal in this case without his knowledge. This court construes Mr. Bailey's motion as a motion to withdraw as counsel. The motion was not accompanied by proof of service as required by NRAP 25(d)(1). Accordingly, on August 9, 2024, this court issued a notice directing Mr. Bailey to provide proof of service of the motion within 7 days. The notice cautioned that failure to comply could result in this court taking no action in regard to the motion. To date, Mr. Bailey has failed to provide proof of service. This court takes no action in regard to the motion to withdraw as counsel. Mr. Bailey is further reminded that a motion to withdraw as counsel will be considered only after trial counsel has complied with the rule by filing the notice of appeal, rough draft transcript request, docketing statement, and fast track briefs. NRAP 3C(b)(3). On July 30, 2024, this court ordered appellant to show cause why this appeal should not be dismissed for lack of jurisdiction and suspended briefing pending further order from this court.
