11/18/2024Order/ProceduralFiled Order. Appellant has not yet been sentenced. 03/05/2025Order/ProceduralFiled Order Denying Stay and Granting Motion to Transmit Presentence Investigation Report. Appellant moved the district court for a stay of execution of sentence, and the district court denied the motion. Appellant has now moved this court for a stay. Appellant predicates his argument on fictitious case law, specifically a case appellant cites as Valdez v. State, 115 Nev. 146 (1999). Respondent called that authority into question in its opposition to the motion for stay. Appellant filed no reply. Appellant has failed to provide relevant authority for this court to consider. Without proper authority and cogent argument, this court need not consider appellant's motion. Accordingly, we deny this motion for stay. The motion to direct the district court clerk to transmit a copy of the presentence investigation report in this matter is granted. The district court clerk shall have 14 days from the date of this order to transmit to the clerk of this court a copy of the presentence investigation report in a sealed envelope. To the extent that appellant is requesting to supplement the record with exhibits not originally filed in the district court, the motion is denied. The clerk of this court shall return, unfiled, the flash drive received on May 22, 2025. Construing appellant's request as a motion for this court to direct the district court to transmit the original exhibits, appellant fails to clearly identify the original exhibits and fails to show that the exhibits are relevant to the issues raised in the appeal and their review is necessary to determination of the issues.
