The letter dated January 12, 2026, could not have been presented to the district court in the underlying proceedings and is not appropriate for consideration on appeal. Appellant has also filed a motion to file a supplemental brief based on newly discovered evidence and for judicial notice of the newly discovered evidence. Appellant represents that his presentence investigation report (PSI) was amended on January 12, 2026, and that his PSI was ordered amended but never corrected. Appellant's requests for relief are all based on the purported amended PSI and/or the district court's reliance on the incorrect PSI. As explained in this court's February 13, 2026, order, the appellate courts' review on appeal is limited to the information presented to the district court in the underlying proceedings. Any amended PSI dated after entry of the order challenged on appeal and not considered by the district court in the underlying proceedings is not appropriate for consideration on appeal. Nor is the purported amended PSI an appropriate subject of judicial notice. Accordingly, appellant's motions are denied. The clerk shall return the supplemental brief received on February 24, 2026, unfiled. However, nothing in this order prevents appellant from seeking appropriate relief in the district court.
