Appellant acknowledges that the supplement that he filed in the district court was not entered into the official record. Accordingly, the motion is denied. The clerk of this court shall return, unfiled, the pro se appendix received on January 29, 2026. Appellant has filed a pro se motion that appears to ask this court to take judicial notice that his presentence investigation report (PSI) was ordered amended in January 2026 and that his goodtime credits were previously miscalculated. The appellate courts' review on appeal is limited to the information presented to the district court in the underlying proceedings. This appeal was docketed in this court in July 2025. Any January 2026 directive to amend the PSI was clearly not before the district court in the underlying proceedings. And whether appellant's goodtime credits were properly calculated is not a matter of fact or law that is an appropriate subject of judicial notice. Accordingly, the motion is denied. To the extent appellant seeks judicial notice of the documents attached to his motion, the motion is also denied. The non-technical violation report, as well as the district court minutes from March 22, 2022, are included in the record on appeal transmitted to this court by the district court clerk and are properly before the appellate courts for review. Accordingly, judicial notice of these documents is unnecessary. Appellant has filed a motion for leave to file a supplement to the informal opening brief. Appellant filed an informal opening brief on November 21, 2025, and another on December 2, 2025. Briefing was completed in this appeal on January 9, 2026. Appellant's motion is denied. Appellant filed a motion for evidentiary hearing to address what he claims are unresolved factual issues. This court does not act as a finder of fact. Accordingly, this court cannot provide the requested relief and the motion is denied. (SC)26-09280
