08/31/2004Order/ProceduralFiled Order. to Request Transcripts and File Docketing Statement and Denying Proper Person Requests. This appeal was docketed in this court on June 15, 2004. Appellant was required to request transcripts and file the docketing statement by June 30, 2004. To date, appellant has failed to file either document. Appellant shall, within 10 days from the date of this order, request transcripts in compliance with NRAP 9(a) and file and serve the docketing statement. Failure to timely comply with this order may result in the imposition of sanctions. On June 18, 2004, appellant submitted a proper person letter addressed to the clerk of this court. In the letter, appellant requests that this court allow her to file documents in proper person, remove her current counsel and remand this appeal for the appointment of alternate counsel. Because we address appellant's letter on its merits, we direct the clerk to file the letter received on June 18, 2004. No good cause having been demonstrated, we deny appellant's request to remove and appoint alternate counsel. Because appellant is represented by counsel we deny her request to file additional documents in proper person. See NRAP 46(b). Appellant shall proceed through counsel in the prosecution of this appeal.04-15804

12/21/2004Order/ProceduralFiled Order. Regarding Transcripts. On October 7, 2004, appellant's attorney, Randall H. Pike, filed a transcript request form that requested the production of transcripts for proceedings conducted on March 5, 2004, March 19, 2004, March 20, 2004, March 22, 2004, March 23, 2004, March 24, 2004, March 25, 2004, March 29, 2004, March 30, 2004, March 31, 2004, April 2, 2004, and April 8, 2004. On November 5, 2004, court recorder Janie Olsen filed several of the requested transcripts. Our review of the district court docket entries indicates that the transcripts for proceedings conducted on March 19, 2004, March 25, 2004, and April 2, 2004, were previously prepared and filed in the district court prior to the docketing of this appeal. Accordingly, appellant improperly requested preparation of these three transcripts. Further, our review of the district court minutes indicates that no proceedings were conducted on March 5, 2004, March 20, 2004, March 22, 2004, March 23, 2004, and March 24, 2004. We therefore conclude that this court has received all the transcripts that were properly requested pursuant to NRAP 9(a). We admonish Mr. Pike for failing to comply with the Nevada Rules of Appellate Procedure in requesting transcripts and for requesting transcripts for dates on which there were no proceedings.04-23212
