On September 7, 2023, appellants filed a motion to recall the remittitur on the basis that "[a]ppellant believes that the Appeals Court has potentially overlooked or misapprehended points of undisputed fact and law and may grant a Petition for Rehearing." Appellants also ask for an extension of time to file a petition for rehearing on the basis that the Court of Appeals order issued on August 4, 2023, was not served until August 23, 2023. Respondent REEC Enterprises, LLC has filed a response and appellants have filed a reply. This court may only recall the remittitur when "inadvertence, mistake of fact, or an incomplete knowledge of the circumstances of the case on the part of the court or its officers, whether induced by fraud or otherwise, has resulted in an unjust decision." The remitter issued in the normal course, and appellants do not demonstrate good cause to recall the remittitur here. Appellants' motion for an extension of time to file a petition for rehearing is untimely and appellants do not demonstrate good cause for an extension of time. Accordingly, the motion is denied.
