Appellant/Cross-Respondent previously filed Chap. 11 bankruptcy and the stay was lifted to allow for mediation. Appellant's counsel has advised that the bankruptcy had to be dismissed, but another bankruptcy petition has recently been filed. Efforts to lift the stay in the new bankruptcy action to allow for mediation are currently underway. Appellant's counsel reported on June 26, 2024 that the stay will not likely be lifted before July 30, 2024 mediation. Until the stay is lifted mediation cannot proceed.
