03/19/2024Order/ProceduralFiled Order Denying Motion. On March 5, 2024, appellant filed a pro se motion to supplement his petition for rehearing with additional documents, which this court construes as a motion for leave to file an appendix. Appellant's motion is denied and the clerk of this court is directed to strike the attachments to appellant's motion. (COA)24-09787
04/24/2024Order/ProceduralFiled Order Regarding Pro Se Filings and Time to File Petition for Rehearing or Review. Edrick Dillard filed, in pro se, a notice on March 5, 2024, stating that he was no longer represented by counsel, as well as a pro se petition for rehearing. As this is a direct appeal from a judgment of conviction, however, appellant is not permitted to proceed pro se. Moreover, a represented party is generally not permitted to file pro se documents. NRAP 46A(a). We therefore direct the clerk of this court to strike those filings. Appellant, through the counsel listed on this case, now has 18 days to file a petition for rehearing or review of the February 22, 2024, order of affirmance, or inform this court that no such petition will be filed. fn1[Although appellant appears to believe that his counsel is no longer representing him in this appeal, that belief is incorrect as appellant's counsel has neither moved to withdraw nor has this court excused appellant's counsel from such representation. See NRAP 46(d)(3) (providing the procedure for withdrawal of attorneys in criminal appeals).] (COA)24-14235

The petition for review was filed as Exhibit 1 to appellant's motion on May 15, 2024. The clerk of this court is directed to detach the petition from appellant's motion and file it as a separate document. No action will be taken on the motion for extension of time to file a petition for rehearing filed on May 14, 2024, in the court of appeals. The clerk shall file this order in both this court and the court of appeals. (COA)24-18859
