05/24/2024Order/ProceduralFiled Order Reinstating Briefing and Amending Caption. Appellants have filed a response to the order to show cause and an amended notice of appeal from a district court order granting respondents Charity Knox and Martin Naughton's motion to dismiss. Respondents have replied, arguing that this court's decision in Bergenfield v. BAC Home Loans Servicing, 131 Nev. 683, 685, 354 P.3d 1282, 1284 (2015) is controlling, and that there has been no final judgment, warranting dismissal of this appeal. Having reviewed the district court's order, appellant's response, and respondents' reply, this court concludes that the appeal may proceed, and reinstates the briefing schedule as follows. Appellant shall have 60 days from the date of this order to file and serve the opening brief and appendix. Thereafter, briefing shall proceed in accordance with NRAP 31(a)(1). The clerk of this court is directed to amend the caption in this appeal to include Charity Knox, R.N. and Martin Naughton, M.D. as respondents in conformance with the caption of this order. The clerk is also directed to add Aaron D. Ford, Attorney General, and Chris Davis, Senior Deputy Attorney General, as counsel for all respondents pursuant to the notice of appearance filed with this court on May 16, 2024. (SC)24-18319

01/17/2025Order/ProceduralFiled Order Denying Motions to Dismiss and for Extension of Time. Currently before the court are respondents' motion to dismiss the appeal for lack of jurisdiction and motion to hold the appeal in abeyance or for an extension of time to file the answering brief. Appellants oppose the motion. While we grant the motion insofar as it seeks to hold briefing in abeyance pending resolution of the motion to dismiss, respondents have not explained why an additional 45 days is needed to file the answering brief once the motion is resolved. Accordingly, the motion is denied insofar as it seeks a 45-day extension. Respondents shall have 14 days from the date of this order to file and serve the answering brief. Thereafter, briefing shall proceed in accordance with NRAP 31(a)(1). B25-KP/EC/PL (SC)25-02681
