This court's review of the district court docket and minute entries indicates that appellant filed a motion for a new trial under NRCP 59 on September 3, 2024. It appears the motion for a new trial may have suspended the finality of the August 29, 2024, order such that its resolution is necessary to the determination of this court's jurisdiction over this appeal. Accordingly, this court holds this appeal in abeyance pending resolution of the motion for a new trial. Having considered the documents before this court as well as the April 14 order, it appears this court has jurisdiction and this appeal may proceed. Cause appearing, appellant's unopposed motion for leave to file an opening brief in excess of the type-volume limitation is granted. Appellant's opening brief was filed on February 28, 2025. Appellant's motion to allow inclusion of an appendix with her opening brief is denied. Accordingly, the clerk of this court shall strike Vol. 1 of the appendix attached to the brief filed on February 28, and Vols. 2 and 3 of the appendix filed on the same date. See NRAP 32(e). The clerk shall further strike the index to appendix filed on March 14, 2025, and the appendix attached to the briefs filed on March 2, 5, 14, and 17, 2025. Respondents shall have 30 days from the date of this order to file and serve an answering brief, if deemed warranted. Additionally, appellant has filed a motion to remove plaintiff NRS Realty Group, LLC, from the complaint below, asserting that the LLC has not retained counsel and cannot remain as a plaintiff in the complaint. Accordingly, appellant's motion to remove the plaintiff LLC from the complaint is denied.
