In a previous appeal before this court with the same parties, Docket no. 86396-COA, the parties were appointed pro bono counsel following a referral to the pro bono appellate program developed by the Pro Bono Committee of the Appellate Litigation Section of the State Bar of Nevada and the Legal Aid Center of Southern Nevada. Such appointment generally guarantees oral argument. In this matter, it is unclear if the counsel representing either party remains appointed as part of that program.
