07/19/2019MotionFiled Proper Person Emergency Motion for Extension of Time to File Brief (Opening Brief). (SC)19-30666
08/22/2019MotionFiled Proper Person Appellant's Urgent Unopposed Motion for a Further Extension of Time to File Brief Due to Clark County District Attorneys Office Refusal to Get Kim's (Kim Blandino) Attorney Copies of his Confiscated Hard Drives and Other Extraordinary and Compelling Circumstances and for Other Emergency Relief and to Suspend Rules Pursuant to NRAP 2 and Demand for This Court to Take Judicial Notice. (SC)19-35178
08/29/2019Order/ProceduralFiled Order Granting in Part and Denying in Part Motion for Extension of Time and Other Relief. Blandino's opening brief or informal brief was originally due by May 16, 2019. Since then, Blandino has been granted several extensions, in part due to complications stemming from a concurrent criminal proceeding; his opening brief was most recently due by August 19, 2019. Instead of filing the opening brief, however, on August 19, Blandino submitted the instant 36-page motion, entitled "unopposed motion for a further extension of time to file brief due to Clark County District Attorneys Office refusal to get Kim's (Kim Blandino's) attorney copies of his confiscated hard drives and other extraordinary and compelling circumstances and for other emergency relief and to suspend rules pursuant to NRAP 2 and demand for this court to take judicial notice." The motion is granted in part and denied in part. We decline to suspend the rules, as no good cause for doing so has been shown. We deny the request to consolidate, as the writ petition in Docket No. 79191-COA has been denied, and even if a petition for rehearing is filed and granted, the two cases will be pending in separate courts. Appellant's request to vacate the August 19 due date is granted to the extent that he seeks an extension of time to file his opening brief under NRAP 31(b)(3). Appellant's Opening or Informal Brief due: 30 days. Accordingly, appellant's requests regarding the JAVS recording, his GPS monitoring device, access to the Regional Justice Center, prosecutorial and punishment immunity, and the cessation of prosecution are improperly sought in this matter. Therefore, they are denied. fn2 [As this matter can be resolved without taking judicial notice of the many events noted by appellant, we decline his request to take judicial notice.] (SC).19-36205
09/26/2019MotionFiled Proper Person Appellant's Urgent Motion for a Further Extension of Time to File Brief due to Extraordinary and Compelling Circumstances and for Other Emergency Relief and to Suspend Rules Pursuant to NRAP 2 and Demand for this Court to Take Judicial Notice and for Urgent Relief to be able to File Motions in Case C-19-341767 Without Fear of Being Thrown in Jail for Contempt. (SC)19-40124
10/10/2019Order/ProceduralFiled Order Denying Motion for Extension of Time. On September 26, 2019, Blandino filed another motion for an extension of time, asserting that extraordinary and compelling circumstances exist. In particular, Blandino points out that he is defending himself in a criminal case and against a requested temporary protection order in another case. Accordingly, those hearings should no longer occupy Blandino's time, and his motion for an extension of time is denied. Blandino shall have 7 days from the date of this order to file an opening brief that complies with the requirements of NRAP 28(a) and NRAP 32 or an informal brief for pro se parties. fn1 [All other relief requested by Blandino is also denied. Blandino, at page 5 of his motion, states that the judge presiding over his pending criminal case has permitted him leave to file appropriate papers in compliance with court rules in that particular case. The district judge has authority to manage the cases assigned to her. Thus, Blandino has been granted the relief he seeks, and there is no basis for this court to intervene by staying the vexatious litigant order.] (SC).19-41991
10/14/2019MotionFiled Proper Person Appellant's Emergency Motion Under NRAP 27(e) for an Extension of Time due to Death of Youngest Brother Brett Blandino and Need to Help with Various Arrangements and or Investigations. (SC)19-42439
10/16/2019Order/ProceduralFiled Order Granting Motion for Extension of Time. Appellant's Opening Brief or Informal Brief due: October 31, 2019. fn1 [Blandino was allowed to file this motion by facsimile transmission under NRAP 25(4)(B) upon his oral request, based on its alleged emergency nature. Motions for an extension of time, however, are not considered emergencies under NRAP 27(e), and no further requests to file such motions by facsimile transmission will be granted.] (SC).19-42890
11/05/2019MotionFiled Proper Person Appellant's Motion to Exceed Page Limits Pursuant to NRAP 32(7) and/or to Suspend Rules as the Brief Submitted is a Combination Brief and Petition for Combination of Extraordinary Relief Including Mandamus and Coram Nobis under Compelling Circumstances. (SC)19-45484
11/20/2019Order/ProceduralFiled Order Granting in Part and Denying in Part Motion to Exceed Page Limit and Suspend Rules. Appellant's November 5, 2019, motion for leave to file an 86-page opening brief is granted, NRAP 32(a)(7)(D); however, to the extent appellant seeks leave to treat this matter as a combined appeal and writ petition, that relief is denied. We direct the clerk of this court to file appellant's opening brief on appeal, which was timely submitted on October 31, 2019, and provisionally received in this court on November 5, 2019.
