09/24/2018Case Status UpdateTransferred from Supreme Court.
09/24/2018Order/ProceduralFiled Order. . This is a pro se appeal in which appellant has filed a motion to disqualify all of the justices of the supreme court. The motion shall be transferred to the court of appeals for resolution. We clarify that, at this time, only appellant's motion is transferred to the court of appeals, and the transfer is for limited purpose of resolving the motion. In light of this order, the clerk shall transfer the motion to the court of appeals; all other documents shall remain filed in this court. The clerk shall file this order in this court and the court of appeals. fn1 [If the parties wish to file any additional documents related to the disqualification motion, such documents shall be captioned " IN the Court of Appeals of the State of Nevada." Additionally, as electric filing is not available in the court of appeals, all documents filed in that court must be filed in person, by mail or third-party commercial carrier, or, if appropriate, by deposit in the Supreme Court drop box or facsimile.]18-902207
09/24/2018MotionFiled Proper Person Motion. Filed Proper Person Appellant's Motion to Disqualify all the Nevada Supreme Court Justices Pursuant to NRS 1.225 and Canon 2 Rule 2.11 and NRAP 35 and Request to Suspend Rule Requiring a Page Limit for this Motion and Allow an Over Sized Motion or Otherwise Allow Filing.18-37255
10/02/2018MotionFiled Proper Person Motion. - Proper Person Appellant's Emergency Motion Pursuant to NRAP 21(6) As Appellant Possibly Needs Relief In Less Than 14 Days Since Appellant Does Not Know If Ruling By The Court Of Appeals on Disqualification Would Come Before A Ruling On This Emergency Motion To Disqualify All The Judges Of The Court of Appeals.18-902304
01/04/2019Order/ProceduralFiled Order Denying Motions to Disqualify. The appeal itself is currently pending before the Nevada Supreme Court. Shortly after the appeal was docketed, appellant filed a "Motion to Disqualify All the Nevada Supreme Court Justices Pursuant to NRS 1.225 and Cannon 2, Rule 2.11 and NRAP 35 and Request to Suspend Rule Requiring a Page Limit for this Motion and Allow an Over Sized Motion or Otherwise Allow Filing." The supreme court transferred only that motion to this court for resolution. Shortly after that motion was transferred to this court, appellant filed an "Emergency Motion Pursuant to NRAP 21(6) as Appellant Possibly Needs Relief in Less than 14 Days Since Appellant Does Not Know if Ruling by the Court of Appeals on Disqualification Would Come Before a Ruling on this Emergency Motion to Disqualify all the Judges of the Court of Appeals," directly with this court. Having reviewed both motions, we conclude there are no grounds for the supreme court justices or the judges of this court to be disqualified from hearing the matters raised this appeal. We deny the motions. fn1 [As the motion was filed in the supreme court, and then later transferred to this court, we deny appellant's request to file "an over sized motion" as moot.] (COA).19-00555
