07/28/2024MotionFiled Appellant's Response to Motion to Strike Order Granting Telephonic Extension and Countermotion to Extend the Time to File Opening Brief to August 5, 2024. (SC)24-26284
08/05/2024Order/ProceduralFiled Order. On March 22, 2024, this court entered an order that, among other things, directed appellant to file and serve the opening brief and appendix by June 20, 2024. However, the clerk inadvertently listed the due date for the brief on this court's docket as July 22, 2024. On July 22, 2024, the clerk entered an order granting appellant a telephonic extension of time, until August 5, 2024, to file and serve the opening brief and appendix. Respondent has now filed a motion to strike the order granting the telephonic extension. Respondent asserts the clerk lacked authority to grant the motion because the extension was requested after the deadline to file the brief had passed. Appellant opposes the motion and countermoves to extend the deadline to file the opening brief and appendix until August 5, 2024. Appellant asserts it relied on the due date on this court's docket. Respondent does not demonstrate that the clerk lacked authority to enter the telephonic extension order. The order was entered because this court's public docket incorrectly identified the date that the opening brief was due. The motion to strike is denied. Appellant's countermotion for an extension of time is granted. Appellant shall have until August 5, 2024, to file and serve the opening brief and appendix. (SC)24-27364
