| 03/26/2024 | Order/Procedural | Filed Order Dismissing Appeal and Reinstating Briefing. When initial review of the docketing statements and documents before this court revealed a potential jurisdictional defect, this court ordered appellant/cross-respondent to show cause why this appeal should not be dismissed for lack of jurisdiction. In particular, it appeared that the portion of the order denying the countermotion for a judgment debtor examination was not appealable. In response to the order to show cause, appellant argues that this court has jurisdiction to consider its appeal of the denial of appellant's countermotion for a judgment debtor examination under NRAP 3A(b)(8) as a special order after final judgment. We are not persuaded by this argument. An order merely enforcing a prior appealable order does not affect the rights of a party growing out of the final judgment and is not appealable as a special order after final judgment. Accordingly, this court dismisses appellant's appeal for lack of jurisdiction. The cross-appeal of the portion of the order denying a motion to set aside a default judgment pursuant to NRCP 60(b) may proceed. The clerk of this court shall amend the caption to designate MMJ America JS LLC as appellant and AZG Limited Partnership as respondent. MMJ America shall have 90 days from the date of this order to file and serve the opening brief and appendix. Thereafter, briefing shall proceed in accordance with NRAP 31(a)(1). | 08/09/2024 | Order/Procedural | Filed Order Granting Motion. Respondent has filed a motion to strike appellant's opposition to its motion to disqualify appellant's counsel and treat the motion to disqualify as unopposed. In support of the motion, respondent points out that appellant's opposition exceeds the permissible page limitation, and appellant did not obtain permission to file an overlength opposition. Appellant opposes the motion to strike and moves for leave to either file the 12-page opposition or to file an amended opposition. In reply, respondent asks that it be permitted to file a 10-page reply to the opposition. Respondent's motion to strike the over-length opposition is granted. The clerk shall strike the opposition filed on July 15, 2024. Appellant's request for leave to file an amended opposition is granted. The clerk shall detach the amended opposition to the motion to disqualify from the opposition filed on July 29, 2024, and file it separately. Respondent's motion for leave to file a 10-page reply is denied at this time. Respondent shall have 7 days from the date of this order to file and serve a reply that complies with the page limitation set forth in NRAP 27(d)(2). fn1[The footnotes in the amended opposition are not in the same size typeface as the body of the brief as required. The district court shall have 60 days from the date of this order to certify and transmit its findings to the clerk of this court, at which time the merits of the motion to disqualify shall stand submitted.
