When initial review of the docketing statements and documents before this court revealed a potential jurisdictional defect, this court ordered appellant/cross-respondent to show cause why this appeal should not be dismissed for lack of jurisdiction. In particular, it appeared that the portion of the order denying the countermotion for a judgment debtor examination was not appealable. In response to the order to show cause, appellant argues that this court has jurisdiction to consider its appeal of the denial of appellant's countermotion for a judgment debtor examination under NRAP 3A(b)(8) as a special order after final judgment. We are not persuaded by this argument. An order merely enforcing a prior appealable order does not affect the rights of a party growing out of the final judgment and is not appealable as a special order after final judgment. Accordingly, this court dismisses appellant's appeal for lack of jurisdiction. The cross-appeal of the portion of the order denying a motion to set aside a default judgment pursuant to NRCP 60(b) may proceed. The clerk of this court shall amend the caption to designate MMJ America JS LLC as appellant and AZG Limited Partnership as respondent. MMJ America shall have 90 days from the date of this order to file and serve the opening brief and appendix. Thereafter, briefing shall proceed in accordance with NRAP 31(a)(1).
