03/15/2024Order/ProceduralFiled Order Dismissing Appeal, Regarding Request for Remand, and Regarding Briefing. The Law Office of Daniel S. Simon and Daniel S. Simon (the Simon parties) move to dismiss their appeal pursuant to NRAP 42 (voluntary dismissal) on the basis that the October 17, 2023, order they challenge on appeal does not appear to resolve all claims for all parties. The Edgeworth Family Trust, Brian Edgeworth, Angela Edgeworth, and American Grating, LLC (the Edgeworth parties) agree Simon's appeal should be dismissed. Cause appearing, the Simon parties' appeal is dismissed. Each party to that appeal shall bear their own fees and costs. The clerk shall modify the caption of this matter accordingly. Within their motion to dismiss, the Simon parties also request a limited remand to the district court to allow for the entry of a stipulation and order dismissing all claims between the Simon parties and Robert Vannah, John Greene, and Robert D. Vannah. Chtd. (the Vannah parties). The Simon parties do not appear to seek to alter, modify, vacate, or otherwise change the orders challenged in the Edgeworth parties' appeal. With the dismissal of the Simon parties' appeal, the Vannah parties are no longer parties to this appeal. And it does not appear that dismissal of the Vannah parties in the district court will affect the merits of the Edgeworth parties' appeal. Therefore, it does not appear that a remand from this court is necessary to dismiss the Vannah parties from the district court litigation and the request for a remand is denied without prejudice. This appeal shall proceed as to the appeal of the Edgeworth parties. The Edgeworth parties shall have 7 days from the date of this order to serve and file, in this court, a file-stamped copy of the transcript request form filed in the district court. Alternatively, if no transcript will be requested, the Edgeworth parties shall file and serve a certificate to that effect within the same time period. The Edgeworth parties shall have 60 days from the date of this order to file and serve the opening brief and appendix. Thereafter, briefing shall proceed in accordance with NRAP 31(a)(1). fn1[ Simon's alternative request to dismiss their appeal in part is denied as moot.] (SC)24-09242
